Gators in the NBA

Two former Gators, David Lee and Joakim Noah, were named to their respective conference?s roster for NBA All-Star Game on Sunday, February 17. In addition to the two, ten former players are active in the NBA this season.

?

Bradley Beal, Washington Wizards

Beal has been playing through an injury and could possibly miss the next game for Washington. He scored in double-figures twice last week and blocked a career-best four shots against Chicago on Saturday, January 26. Beal is averaging 13.2 ppg, 3.3 rpg, and 2.5 apg for the Wizards.

?

Matt Bonner, San Antonio Spurs

Bonner has played in 40 games for San Antonio this season, averaging 4.0 pph and 2.0 rpg. This past week, Bonner scored 16 points and pulled down nine rebounds in four games.

?

Corey Brewer, Denver Nuggets

Brewer has played in every game for Denver this year, averaging 11.2 ppg and 3.3 rpg. In the team?s last outing against Indiana on Monday, January 28, Drewer recorded 16 points off the bench.

?

Udonis Haslem, Miami Heat

Haslem and fellow former Gator Mike Miller visited the White House this past week with the Miami Heat, the 2012 NBA Champions. The team?s all-time leader in rebounds has played in 39 games this season, starting 23. He is averaging 3.6 ppg and 5.5 rpg. Against Toronto on Wednesday, January 23, Haslem pulled down 10 rebounds which marked the fourth time this year he had recorded at least 10 boards.

?

Al Horford, Atlanta Hawks

Like Beal, Horford is fighting injuries as of late. He missed one game early last week, but came back against Boston on Friday, January 25 and recorded 24 points and 13 rebounds. It marked his sixth double-double of the month. On the season, Horford is averaging 15.9 ppg and 9.8 rpg.

?

David Lee, Golden State Warriors

The now two-time All-Star Lee is currently tied for sixth in rebounding and is the 12th-leading scorer in the league, averaging 19.6 ppg and 10.9 rpg. This past week, Lee recorded at least 20 points in all five of Golden State?s games. He also had four doubles-doubles.

?

Mike Miller, Miami Heat

In 37 games, Miller is averaging 3.8 ppg and 2.3 rpg. Last week, Miller played in two games for Miami, scoring two points and pulling down five rebounds.

?

Joakim Noah, Chicago Bulls

The first-time All-Star Noah had a monstrous week on the boards last week, averaging an absurd 17.3 rpg in four games. With this amazing stretch, he raised his rebounding average 0.6 ppg and is now ranked third in the league in rebounding. Along with Lee, Noah is one of nine players in the league to be averaging a double-double (12.1 ppg and 11.3 rpg).

?

Chandler Parsons, Houston Rockets

Parsons is averaging 14.1 ppg, 5.8 rpg, and 3.6 apg for Houston in 46 games this year. He scored in double figures in three of four games this past week. Parsons also tallied a double-double, 16 points and a career-best 11 assists, for his first double-double of that variety in his career.

?

Marresse Speights, Cleveland Cavaliers

Since joining Cleveland last week, Speights has found his scoring touch. He has scored at least 10 points in every game he has played in for the Cavaliers. Speights is averaging 7.0 ppg and 4.8 rpg this season.

Kwame Harris, Ex-49ers OT, Charged With Domestic Violence After Alleged Assault Of Former Boyfriend

SAN FRANCISCO -- Former San Francisco 49er Kwame Harris has been charged with felony domestic violence and assault charges from an August beating involving a former boyfriend, a prosecutor and defense lawyer said.

Following a pretrial hearing in the case Monday, a San Mateo County judge set a late April trial date for Harris, an offensive tackle who played five seasons with the 49ers and one season with the Oakland Raiders, Assistant District Attorney Al Serrato said.

The charges stem from an altercation outside a Menlo Park restaurant between Harris, 30, and Dimitri Geier, who suffered several facial fractures that required surgery, Serrato said.

Although a handful of former NFL players have come out as gay, none has while still wearing a uniform. Defense lawyer Alin Cintean said Harris, who played for Stanford before he was drafted by the 49ers in 2003 and has gone back to school to finish his undergraduate degree, identifies as gay, but "is not very public about it."

"He is a very private person. He doesn't like to talk about his personal life," he said.

Prosecutors are pursuing the domestic violence charge because the two men used to live together and had an on-again, off-again romantic relationship, Serrato said.

"Whenever we move forward with charges, it's because we believe the evidence is sufficient," Serrato said. "Certainly the injuries are consistent with a serious assault."

Harris has pleaded not guilty and posted $75,000 bail after his arrest, Cintean said. Harris acknowledges he and Geier once were a couple, but says he struck Geier in self-defense, Cintean said.

"Mr. Geier first assaulted my client, and my client had a reasonable response to being assaulted," he said. "Unfortunately, Mr. Geier is the one who ended up with an injury."

News of the charges was reported first Monday by the San Mateo Daily Journal.

Coulton, Glee, and Copyright | madisonian.net

Is Jonathan Coulton right? ?And does it matter?

Sir Mix-a-Lot released ?Baby Got Back? in 1992. ?Jonathan Coulton covered ?Baby Got Back? in 2005 using a new (let us say, ?original,? both in the copyright sense of that word and in its ordinary but different everyday sense) arrangement. ?The TV show Glee provoked a controversy recently by performing a version of ?Baby Got Back? that sounds nearly identical to Coulton?s version.

The various possible worlds of the Internet are a-flutter over the alleged appropriation of Coulton?s work by the producers of Glee.

Read summaries of the controversy here, here, and here. ?The emerging consensus is that Glee may not have done anything wrong by the lights of copyright law, but stepped over the line ethically.

True? ?Let?s walk through the law first, then some ethics. ?There are few answers ahead, but perhaps some added ways of seeing through the mist.

As to the law:

What ?rights? does Coulton have in his cover of ?Baby Got Back?? ?This depends on how Coulton went about producing the cover.

Possibility 1 is that Coulton did what he claims the producers of Glee should have done: ?He went to Sir Mix-a-Lot and asked for permission. ?The musicians would have worked out a deal on rights, royalties, and so forth. ?In that deal they could have worked out whether Mix required that Coulton should have to assign Coulton?s publishing rights (rights in the newly-arranged version of the song) in the cover to Mix ? a deal that Mix could easily have insisted on. ?By contrast, Mix could have told Coulton to keep the publishing rights and instead pay Mix some amount of royalties ? or nothing at all. ?Again, all of the terms could have been worked out. ?Had Coulton asked.

Which, so far as I can tell, he did not. ?Coulton did not ask for Sir Mix-a-Lot?s permission to cover the song. ?Let?s stow that point away for later, when we come back to the question of whether Glee should have asked Coulton for his permission.

Possibility 2 is that Coulton obtained the right to cover ?Baby Got Back? by complying with Section 115 of the U.S. Copyright Act, which speaks to covers (sometimes known as ?mechanical licensing,? or ?mechanicals,? for historical reasons.) ?As most people in the musical world know, Section 115 is a great deal for many musicians who can?t afford to negotiate for rights to previously-released work. ?The cover artist has the legal right to make the cover without asking the owner of the copyright in the original song, so long as the cover artist complies with some accounting formalities (in terms of royalties to the original songwriter, the cover is not cost-free, but it is low cost) and so long as the cover does not change ?the basic melody or fundamental character of the work? (a legal standard that is virtually never challenged in court). ?In exchange for granting the cover artist low-cost access to source material, Section 115 disallows the cover artist from claiming any rights in the arrangement of the cover version as a derivative of the original ? unless the original songwriter agrees that he/she may. ?What that means, in plain English, is that ordinarily the cover artist gets no rights in the new arrangement used to produce the cover version. ?(Who gets those rights? ?Answer: ?Under Section 115, the arrangement falls into the public domain. ?The cover artist cannot claim it, because Section 115 says so, and the original songwriter cannot claim it, because the original songwriter is not its author.)

Possibility 3 is that Coulton obtained his rights to cover ?Baby Got Back? by licensing those rights from the Harry Fox Agency, or HFA, which acts on behalf of a very large population of songwriting copyright owners in administering some or all of their copyrights. ?An HFA license for a cover is in many ways similar to a Section 115 license, particularly in the sense that an HFA license specifically says that it grants rights that are no greater and no less than the rights that would have been applicable under Section 115.? In some ways an HFA license is not the same, because it is a contract between the original songwriter and the cover artist, rather than a legal grant authorized by Congress. ?But for our purposes the distinction is unlikely to matter. ?In both cases, the original songwriter is ordinarily not consulted in advance by the cover artist, except through the agency of HFA. ?My understanding is that Coulton used either Section 115 or an HFA license to produce his cover. ?That means that in all likelihood, he did not get Sir Mix-a-Lot?s permission. ?And he does not have any copyright in his arrangement.

That?s a summary of the law regarding the arrangement. ?There is one more bit of legality to consider, which is Coulton?s rights in the sound recording of his cover ? that is, the actual recording, rather than the arrangement. ?Section 115 does not say anything about rights in the recording, and in fact Coulton does have standing, at least, to make a claim about the recording. ?But that claim is relatively limited. ?The relevant statute is Section 114, which says in effect that a copyright owner has rights over the actual sounds as they are actually recorded (this would include samples as well as copies of the full recording). ?Soundalike recordings are specifically OK.

So, my conclusion, along with that of a lot of other law professors and copyright specialists, is that Coulton?s possible copyright claim is either very weak (maybe Glee copied his recording?) or nonexistent. ?You could argue that the law regarding covers is wrong, and should be changed (maybe cover artists should have independent rights in their arrangements). ?I don?t think so, but that?s fair territory for debate.

What?s more interesting, of course, is how the ground has shifted so quickly to the so-called ethics of the situation. ?Why didn?t the producers of Glee just pick up the phone? ?Wouldn?t that have been fair? ?Or at least the right thing to do?

American copyright law is well-known within the broad (and somewhat vague) setting of international copyright law for its rejection of most ethical arguments about copyright ownership and enforcement. ?In the US, copyright is mostly an economic construct; it is an engine for markets in copyrighted works, the means by which authors and publishers can profit by selling copies of copyrighted material, and access to it. ?But that conceptual framework has not stopped observers, including many legal scholars and copyright lawyers, from making appeals to the ethics of knowledge and information creation, distribution, and consumption. ?You can try to take copyright out of the ethical minefield, but you can?t take the ethical minefield out of copyright.

What ethical result in Coulton?s case, then? ?The answer, I think, depends on your underlying ethical framework.

One way to look at this situation is through Lockean goggles. ?We could say that Jonathan Coulton earned the right to profit from his creative labors, and he has a claim on the world at large for any use of his labor that unjustly deprives him of its value ? that is, that either deprives him of its value on terms to which he does not consent, or deprives him of its value without subjecting the use to a corresponding and more or less equivalent burden (which is to say, that the use might not be unjust if Coulton were paid, but that the user need not be the party that pays). ?In ethical terms, if not in legal terms, Glee?s actions are unjust, because Glee has profited (used Coulton?s arrangement) without paying a fair toll (whether in terms of permission or price or both) to Coulton.

The difficulty with this argument, it seems to me, is that Coulton is well-known in the musical world for having relied on voluntary contributions from fans and others to support his career. ?He offers his music to the world; the world takes; and if the world chooses, then the world sends him money. ?He?s relied on that model for many years, and he?s been pretty successful at it ? at least, successful enough that he was able to leave his ?day job? a while back.

Why does that complicate Coulton?s ethical claim? ?In my view, Coulton has not just participated in but has actively encouraged the development of a gift economy around his music. ?He gives it away. ?(I looked at his website; I didn?t see any evidence of limitations or restrictions on what people might do with the songs.) ?If we measure the justice of Coulton?s circumstance from the point of view of Coulton?s subjective valuing of his labors, then there is no injustice; Couton received exactly what he intended ? which is to say, nothing, both in terms of money and in terms of unquantifiable ?respect.? ?If we measure the justice of Coulton?s circumstance from the point of view of a more objective comparison of the value of Coulton?s labor and the benefit that Glee received, it?s difficult (though not impossible) to come to a different conclusion. ?(Perhaps Coulton?s complaint that he should have been consulted in advance represents the difference, which is minor in objective terms, but if we?re running some objective calculus, Glee?s side of the ethical ledger should include not only the relatively modest burden of making the call but also the relatively modest benefit of using the arrangement). ?My bottom line for the moment: ?If Coulton really did freely and willingly give away copies of his songs (i.e., in this case, arrangements), then I think that his ethical position ? in Lockean terms ? is pretty weak.

But there?s more.

A second and different way to look at Coulton?s ethical claim is through a set of reciprocity goggles. ?In that case, the gift character of Coulton?s work is a strength, not a weakness. ?In a lot of gift economies though far from all of them, the gift community is characterized by an ethos of reciprocity. ?One may not take something from the community as a gift without returning other material to the community as a gift, or (not and), one must pay forward the gift character of the material when ?re-gifting? it. ?(Creative Commons and open source licensing are, in part, examples of gift economies.) ? There are different flavors of this argument, too. ?Under one flavor ? once a gift, always a gift, let us say ? Coulton is in the ethical right, and Glee is in the ethical wrong: ?Glee took Coulton?s gift and re-purposed it commercially, exploiting the gift for money rather than re-gifting it as Coulton had in the first place. ?Under a different flavor ? treat others as you would have them treat you, which is a more Kantian flavor, let us say ? then Coulton is again on shaky ground: ?He did not ask Sir Mix-a-Lot for permission to use ?Baby Got Back,? and accordingly has little ethical standing when he (Coulton) turns around and demands that the Glee producers ask him for permission. ?To Coulton, one would say: ?What?s sauce for the goose is sauce for the gander.

In short, it seems to me that Coulton?s ethical arguments have some strengths and have some weaknesses. ?Where he stands depends very much on where he sits.

Finally ? and if you?ve read this far, then thank you ? what, if anything, does this all mean? I think that the conclusion about ethics says it all: ?Nothing in the creative world is as straightforward as it seems, and when you combine that fact with the copyright world, a certain combustibility is almost inevitable. ?If it is evidence of nothing else, the Coulton/Glee blowup is evidence ?that there is virtually nothing that courts, Congress, and treaty makers can do to persuade artists, music lovers, commercial entertainment producers (among many other people) that they should think like copyright policymakers rather than as people of diverse human sensibilities.

Speakers:
- ECB's Coene:
There was no currency war at this time and still far from having one
- Chancellor Osborne commented that its domestic economy had both internal and external issues and must also address borrowing and deficit topics
- ECB member Costa (Portugal) commented that Portugal public sector reforms were still not enough for sustainable public finances. He added that some of the reforms had been successful but saw risk of reform fatigue in public sector
- ECB commented on Liikanen report into banking sector reform and called for impact assessment to gauge effects of proposals in EU and could have significantly different impact across the region. ECB supported proposals to bail-in banks' creditors and saw merit in separating risk activities from client activities
- OECD Chief Economist Padoan believed major central banks (FED, BOE and BOJ) should continue quantitative easing measures and that fruits from Euro Zone consolidation efforts would be seen sooner rather than later. He added that the BOJ could be bold given the country's fiscal consolidate while fiscal clarity was key to Fed's QE outlook. The view on currency wars taking place was overstating what is occurring. OECD forecasts from Nov remained valid, but risks have shifted.
- China official: Weaker Japanese Yen impact has been muted but trade might get hit
- US envoy to North Korea Davies: Sees no immediate prospect for diplomacy with North Korea

Currencies:
- A relatively quiet European calendar provided an opportunity for recent FX price action to consolidate. The rhetoric on currency wars has seemed to pick up in the financial press, particularly after the JPY's 10-week decline against the major pairs. The upcoming G20 meeting in February was being cited as the proper venue to discuss FX issues.
- GBP/USD hit 5-month lows of 1.5716 and continued to trade under pressure amid triple dip recession risk after a weak Q4 growth reading last week. Dealers were also taking notice of dovish comments from incoming BOE Gov Carney made over the weekend at Davos.
- The EUR/USD was little changed in subdued trading but remained above the 1.34 handle, which was the breakout level from Friday.
- The JPY currency consolidated from its recent spat of weakness.

Political/ In the Papers:
- (EU) ECB's Coene: Higher than expected LTRO payments could bring down EMU yield spreads further; Euro's level right now is not a problem but may become dangerous; Sees no need for additional monetary easing at the moment; Expects some upside in European and Belgian economies; Ideally, ECB's OMT bond buying program would never be used so as to avoid risk of diminished commitment to austerity
- (EU) ECB official at Davos: ECB is "not very happy" with a step toward competitive devaluations, which should be discussed by G20 at the meeting next month - financial press
-(EU) EU Trade Chief De Gucht: would be good if the euro got a little bit lower; euro appreciation is not good for exports; Cannot see a scenario in which Europe would intervene in the Forex market.

(AP) ? An unpredictable new element has entered Egypt's wave of political unrest: a mysterious group of masked young men called the Black Bloc who present themselves as the defenders of protesters opposed to the Islamist president's rule.

They boast that they're willing to use force to fight back against Islamists who have attacked protesters in the past ? or against police who crack down on demonstrations. The youths with faces hidden under black masks have appeared among stone-throwing protesters in clashes with police around Egypt the past five days in the wave of political violence that has shaken the country.

During protests in Cairo on Monday, masked youths celebrated around a police armored vehicle in flames in the middle of Tahrir Square, waving their hands in V-for-victory signs.

Their emergence has raised concerns even among fellow members of the opposition, who fear the group could spark Islamist retaliation or that it could be infiltrated to taint their movement. Islamist supporters of President Mohammed Morsi call the bloc a militia and have used it to depict the opposition as a violent force wrecking the nation.

Moreover, some Islamists have threatened to form vigilante groups in response, creating the potential for a spiral of violence between rival "militias."

The bloc's appearance comes amid increasing opposition frustration with Morsi, Egypt's first freely elected president, and the Muslim Brotherhood and other Islamists who critics say have imposed a monopoly on power.

The anger has fueled the explosion of violence that at first centered on Friday's second anniversary of the start of the uprising that ousted autocrat Hosni Mubarak. It accelerated with riots in the Suez Canal city of Port Said by youths furious over death sentences issued by a court against local soccer fans over a bloody stadium riot a year ago. Morsi has struggled to regain control, calling a state of emergency in three Suez Canal-area provinces.

The Black Bloc models itself after anarchist groups by the same name in Europe and the United States that have participated in anti-globalization and other protests the past decade.

In Egypt, the group's secrecy and self-professed dispersed structure make it difficult to determine its actual scope. It communicates mainly by online social media. Its members' identities are unknown and faces unseen, so it's impossible to confirm the authenticity of those who claim to speak in its name.

It's even impossible to know whether every masked young man in the streets belongs to the block or is just a protester hiding his face ? or if the distinction even matters. In Tahrir on Monday, vendors were selling black masks that young men crowded to buy.

"We are the Black Bloc ... seeking people's liberation, the fall of corruption and the toppling of the tyrant," proclaimed a video announcing the group's formation, posted online Thursday. It showed youths dressed in black marching in lines in the Mediterranean city of Alexandria.

"We have arisen to confront the fascist tyrant regime of the Muslim Brotherhood with its military wing," the video said, warning police not to interfere "or else we will respond without hesitation."

Brotherhood officials, Islamist politicians and pro-government media accuse the group of violence ranging from trying to set fire to the presidential palace and attacking Brotherhood offices to ransacking state buildings, blocking train tracks and even exchanging gunfire with riot police.

The mayhem of the past five days has seen such incidents ? but it is unclear what role Black Bloc members have had, or whether claims the group is armed are true. Security officials say they arrested one suspected bloc member carrying ammunition in Cairo on Sunday.

The state-run Al-Ahram newspaper, which has depicted the group as fueling violence, said that Black Bloc members tried to break into a five-star hotel near Tahrir, and fired guns in the air when other protesters tried to stop them.

A university graduate named Sherif el-Sherafi said he was a founder of the group in an interview with the El-Watan newspaper ? though his claims could not be independently confirmed.

He said the bloc has 10,000 members nationwide, organized into groups of around 20 each, but with no chain of command. Members are trained in self-defense and how to deal with tear gas.

"Violence is not an action but a reaction," he said. He depicted the situation as an inevitable clash between the opposition and government. "What is coming is worse."

Members say the group was created in response to Dec. 4 clashes, when Brotherhood supporters attacked a protest sit-in outside the presidential palace, touching off hours of street battles that left at least 10 dead and hundreds injured.

Many in the opposition saw that incident as a turning point, a sign that Islamists and the Brotherhood were willing to use violence against Morsi's critics.

Monday night, a number of protesters praised the masked men in Tahrir Square.

"They aren't here for sabotage or vandalism, but to protect us from Brotherhood militias," said Ahmed Ali, an engineer.

Ali said police are now "suppressing the revolution on behalf of the murderer Morsi ... So we need these men to defend the revolution."

Hossam al-Hamalawy, a prominent lefist activist, said the Black Bloc youth are "sincere, they want change and they have seen their friends get killed... (So) they have decided to take the matter into their own hands."

But he said it "could be dangerous for the revolution," warning that "this could develop to people carrying arms" ostensibly in response to the Black Bloc.

"Those who topple the regime are the masses," not underground groups, said al-Hamalawy, of the Socialist Revolutionaries, a key group behind the anti-Mubarak uprising.

Morsi's office and the Brotherhood have contended for months that the opposition is using the streets to overturn results of elections that Islamists have consistently won.

Now they point to the Black Bloc as proof their opponents are willing to back violence.

On his Facebook page, Morsi's assistant for foreign affairs Essam el-Haddad accused the Black Bloc of "systematic violence and organized crimes across the country" and accused the opposition of condoning it.

The Brotherhood in a statement denounced "groups of thugs, militias of black gangs" that it accused of attacks on state institution, police and private property. "The silence of opposition political parties on such crimes ... indicates their support."

Morsi's more hard-line Islamist allies have been more vehement.

The Black Bloc "must be liquidated completely. These groups must be dealt with with violence and all force," said Mohammed Abu Samra, head of the political party of Islamic Jihad, which once waged a campaign of militant violence in Egypt.

Some ultraconservatives accused Christians of being behind the bloc, in line with their past attempts to fire up their base with warnings that minority Christians are trying to topple Morsi.

Another former jihadi group, the Gamaa Islamiya, threatened on Sunday to create a vigilante group.

Tareq el-Zomr, a leading figure in the group, said that if security forces don't bring quiet, "it will be the right of the Egyptian people ? and us at the forefront ? to set up popular committees" to protect property and "counter aggression."

A Facebook page also claimed the formation of a new militia called the "Muslims Brigade" ? though it was not possible to confirm that the group exists.

In a video on the page, a group of masked men holding rifles warned of plots by enemies of Islam and a conspiracy by Christians to turn Egypt into a Christian state and accused the main opposition National Salvation Front of helping "burn Egypt."

Deadly smoke, lone blocked exit: 230 die in Brazil

PORTO ALEGRE, Brazil (AP) ? Flames raced through a crowded nightclub in southern Brazil early Sunday, killing more than 230 people as panicked partygoers gasped for breath in the smoke-filled air, stampeding toward a single exit partially blocked by those already dead. It appeared to be the world's deadliest nightclub fire in more than a decade.

Witnesses said a flare or firework lit by band members started the blaze in Santa Maria, a university city of about 225,000 people, though officials said the cause was still under investigation.

Television images showed smoke pouring out of the Kiss nightclub as shirtless young men who had attended a university party joined firefighters using axes and sledgehammers to pound at windows and walls to free those trapped inside.

Guido Pedroso Melo, commander of the city's fire department, told the O Globo newspaper that firefighters had a hard time getting inside the club because "there was a barrier of bodies blocking the entrance."

Teenagers sprinted from the scene desperately seeking help. Others carried injured and burned friends away in their arms.

"There was so much smoke and fire, it was complete panic, and it took a long time for people to get out, there were so many dead," survivor Luana Santos Silva told the Globo TV network.

The fire spread so fast inside the packed club that firefighters and ambulances could do little to stop it, Silva said.

Another survivor, Michele Pereira, told the Folha de S. Paulo newspaper that she was near the stage when members of the band lit flares that started the conflagration.

"The band that was onstage began to use flares and, suddenly, they stopped the show and pointed them upward," she said. "At that point, the ceiling caught fire. It was really weak, but in a matter of seconds it spread."

Guitarist Rodrigo Martins told Radio Gaucha that the band, Gurizada Fandangueira, started playing at 2:15 a.m. "and we had played around five songs when I looked up and noticed the roof was burning"

"It might have happened because of the Sputnik, the machine we use to create a luminous effect with sparks. It's harmless, we never had any trouble with it.

"When the fire started, a guard passed us a fire extinguisher, the singer tried to use it but it wasn't working"

He confirmed that accordion player Danilo Jacques, 28, died, while the five other members made it out safely.

Police Maj. Cleberson Braida Bastianello said by telephone that the toll had risen to 233 with the death of a hospitalized victim ? he said earlier that the death toll was likely made worse because the nightclub appeared to have just one exit through which patrons could exit.

Officials counted 232 bodies that had been brought for identification to a gymnasium in Santa Maria, which is located at the southern tip of Brazil, near the borders with Argentina and Uruguay.

Federal Health Minister Alexandre Padhilha told a news conference that most of the 117 people treated in hospitals had been poisoned by gases they breathed during the fire. Only a few suffered serious burns, he said.

Brazil President Dilma Roussef arrived to visit the injured after cutting short her trip to a Latin American-European summit in Chile.

"It is a tragedy for all of us," Roussef said.

Most of the dead apparently were asphyxiated, according to Dr. Paulo Afonso Beltrame, a professor at the medical school of the Federal University of Santa Maria who went to the city's Caridade Hospital to help victims.

Beltrame said he was told the club had been filled far beyond its capacity during a party for students at the university's agronomy department.

Survivors, police and firefighters gave the same account of a band member setting the ceiling's soundproofing ablaze, he said.

"Large amounts of toxic smoke quickly filled the room, and I would say that at least 90 percent of the victims died of asphyxiation," Beltrame told The Associated Press by telephone.

"The toxic smoke made people lose their sense of direction so they were unable to find their way to the exit. At least 50 bodies were found inside a bathroom. Apparently they confused the bathroom door with the exit door."

In the hospital, the doctor "saw desperate friends and relatives walking and running down the corridors looking for information," he said, calling it "one of the saddest scenes I have ever witnessed."

Rodrigo Moura, identified by the newspaper Diario de Santa Maria as a security guard at the club, said it was at its maximum capacity of between 1,000 and 2,000, and partygoers were pushing and shoving to escape.

Santa Maria Mayor Cezar Schirmer declared a 30-day mourning period, and Tarso Genro, the governor of the southern state of Rio Grande do Sul, said officials were investigating the cause of the disaster.

The blaze was the deadliest in Brazil since at least 1961, when a fire that swept through a circus killed 503 people in Niteroi, Rio de Janeiro.

Sunday's fire also appeared to be the worst at a nightclub since December 2000, when a welding accident reportedly set off a fire at a club in Luoyang, China, killing 309.

In 2004, at least 194 people died in a fire at an overcrowded nightclub in Buenos Aires, Argentina. Seven members of a band were sentenced to prison for starting the flames.

Several years later, in December 2009, a blaze at the Lame Horse nightclub in Perm, Russia, killed 152 people after an indoor fireworks display ignited a plastic ceiling decorated with branches.

Similar circumstances led to a 2003 nightclub fire that killed 100 people in the United States. Pyrotechnics used as a stage prop by the 1980s rock band Great White set ablaze cheap soundproofing foam on the walls and ceiling of a Rhode Island music venue.

The band performing in Santa Maria, Gurizada Fandangueira, plays a driving mixture of local Brazilian country music styles. Guitarist Martin told Radio Gaucha the musicians are already seeing hostile messages.

"People on the social networks are saying we have to pay for what happened," he said. "I'm afraid there could be retaliation".
