While there was much excitement (whether it was negative or positive)?surrounding the new laws passed to legalize the use of marijuana in Washington and Colorado, it appears these states might not be as cloud covered as expected.
Most importantly, it is still illegal to grow and sell marijuana in both states. So while it is technically legal to carry up to one ounce of marijuana?where anyone would legally obtain the drug is a mystery. When it comes to purchasing medical marijuana, a prescription is required.?Therefore?it seems that if this drug is being carried, it would generally have to be acquired through an illegal source. It seems that this issue?may not be a?pressing?matter quite yet for employers, mostly?in regards to worries over their employees using?the drug during work as well as previous to coming in to work.?From the perspective?of?background checks, how and when could this affect the background screening process for employers? Once the law is sorted out, how will past substance abuse be viewed by employers? These are just a couple of questions to consider.
One instance where?there is uncertainty?for employers is?considering how they should respond if an employee comes to work under the influence of marijuana. CNN reported that ?Twenty Colorado business groups have appealed to Holder to enforce federal pot laws, because of questions about how to deal with workers who are high.?
Seattle on the other hand has taken this issue a step further and?created a guidebook in order to assist others?with understanding what the law requires when it comes to obtaining, carrying, and using the drug. It is possible that a license to grow and sell marijuana will be initiated in the future, but until then, it is still illegal. It looks like it might be awhile before both states have figured out all of the logistics?with this new law.
